End User Licence Agreement

Please read this agreement before installing Qboqo Analytics. By installing or using the software you accept these terms. If you do not accept them, do not install the software.
1. Who this agreement is between
This agreement is between you, either personally or on behalf of the organisation you represent, and Dugong International PVT LTD, a company incorporated in India ("we", "us"). It covers the Qboqo Analytics software, the documentation that ships inside it, and any updates we supply to you under these same terms.
2. What you may do
We grant you a non-exclusive, non-transferable, royalty-free licence to install and use Qboqo Analytics on any number of computers you or your organisation own or control, for any purpose, including commercial work.
The software is free of charge. There is no licence key, no activation, no account, no subscription, no trial period and no limit tied to your machine. Nothing in the software stops working after a period of time, and nothing in it needs our permission to keep running.
You may copy the software in order to install it, and you may keep copies for backup.
3. What you may not do
You may not sell the software, or distribute it as part of something you sell, without our written permission. You may not remove or alter the copyright notices, the publisher name, or the third-party notices that ship with it. You may not represent the software as your own work.
You may not reverse engineer, decompile or disassemble the software, except where that restriction is prohibited by law that applies to you, and then only to the extent that law allows.
4. Who owns it
We own the software, and this agreement gives you permission to use it rather than ownership of it. All rights we do not grant you here remain ours.
Your data is yours. We claim no right of any kind over the data you load into the software, the reports you build with it, or the files it writes.
5. Components we did not write
Qboqo Analytics includes components published by others. They are listed, with their own licence terms, in the file THIRD-PARTY-NOTICES.txt that is installed beside the application. Those components are governed by their own licences and not by this agreement, and where a term of this agreement conflicts with one of theirs, theirs applies to that component.
6. The installer itself
The program that installs Qboqo Analytics is built on the WiX Toolset, and parts of it are included in the installer you are running. Those parts are:
- the WiX standard bootstrapper application, which draws the windows you are reading now;
- the layout and wording files for those windows, which are the WiX Toolset's own files with the product's
icon and one button caption changed by us.
They are published by the .NET Foundation and contributors under the Microsoft Reciprocal License, the full text of which is included with this installer and is also at http://opensource.org/licenses/ms-rl. That licence governs those parts rather than this agreement.
The source code for those parts is available. The WiX Toolset's own source is published at https://github.com/wixtoolset, and the changed layout and wording files are available from us on request at no charge. This paragraph is our written offer of that source.
7. Privacy
Qboqo Analytics runs entirely on your computer. It has no account, collects no telemetry, sends no usage data, checks for no updates, and opens no network connection other than to a database server you name yourself.
We therefore receive nothing from your use of the software, and we cannot see your data, your reports or your activity.
8. No warranty
The software is provided "as is", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the software will be free of defects, that it will meet your requirements, or that its operation will be uninterrupted or error-free.
You are responsible for checking results that matter. The software is a tool for analysing data, and the conclusions you draw from it are yours.
9. Limits on our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, nor for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to the software or this agreement, whatever the legal basis of the claim and even if we were told such loss was possible.
Where liability cannot lawfully be excluded, our total liability arising out of or relating to the software and this agreement is limited to the greater of the amount you paid us for the software, which for this software is nothing, or one thousand Indian Rupees.
Nothing in this agreement limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
10. How this agreement ends
This agreement applies for as long as you use the software. You may end it at any time by uninstalling the software and deleting your copies.
It ends automatically if you breach its terms, in which case you must stop using the software and remove it. Sections 4, 5, 6, 8, 9 and 11 continue to apply after it ends.
11. Which law applies
This agreement is governed by the laws of India, and the courts at Delhi have exclusive jurisdiction over any dispute arising out of it.
12. Everything else
This agreement is the entire agreement between you and us about the software, and it replaces anything said or written before it on that subject.
If any part of it is found unenforceable, the rest continues to apply, and the unenforceable part is treated as changed only so far as is needed to make it enforceable.
Our not enforcing a term on one occasion does not mean we give up the right to enforce it later.
Appendix: Microsoft Reciprocal License (MS-RL)
This is the licence referred to in section 6. It governs the parts of the installer published by the .NET Foundation and contributors, and not the Qboqo Analytics software itself.
Microsoft Reciprocal License (MS-RL)
This license governs use of the accompanying software. If you use the software, you accept this license. If you do not accept the license, do not use the software.
1. Definitions
The terms "reproduce," "reproduction," "derivative works," and "distribution" have the same meaning here as under U.S. copyright law.
A "contribution" is the original software, or any additions or changes to the software.
A "contributor" is any person that distributes its contribution under this license.
"Licensed patents" are a contributor's patent claims that read directly on its contribution.
2. Grant of Rights
(A) Copyright Grant- Subject to the terms of this license, including the license conditions and limitations in section 3, each contributor grants you a non-exclusive, worldwide, royalty-free copyright license to reproduce its contribution, prepare derivative works of its contribution, and distribute its contribution or any derivative works that you create.
(B) Patent Grant- Subject to the terms of this license, including the license conditions and limitations in section 3, each contributor grants you a non-exclusive, worldwide, royalty-free license under its licensed patents to make, have made, use, sell, offer for sale, import, and/or otherwise dispose of its contribution in the software or derivative works of the contribution in the software.
3. Conditions and Limitations
(A) Reciprocal Grants- For any file you distribute that contains code from the software (in source code or binary format), you must provide recipients the source code to that file along with a copy of this license, which license will govern that file. You may license other files that are entirely your own work and do not contain code from the software under any terms you choose.
(B) No Trademark License- This license does not grant you rights to use any contributors' name, logo, or trademarks.
(C) If you bring a patent claim against any contributor over patents that you claim are infringed by the software, your patent license from such contributor to the software ends automatically.
(D) If you distribute any portion of the software, you must retain all copyright, patent, trademark, and attribution notices that are present in the software.
(E) If you distribute any portion of the software in source code form, you may do so only under this license by including a complete copy of this license with your distribution. If you distribute any portion of the software in compiled or object code form, you may only do so under a license that complies with this license.
(F) The software is licensed "as-is." You bear the risk of using it. The contributors give no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws which this license cannot change. To the extent permitted under your local laws, the contributors exclude the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
